Arbitrasie is ‘n alternatief tot litigasie, en is beskikbaar wanneer die partye ooreenkom dat ‘n spesifieke persoon, of ‘n persoon genomineer deur ‘n onafhanklike derde party soos ‘n prokureurs orde, die dispuut tussen hulle besleg. Die grootste voordeel van arbitrasie bo litigasie is dat dit ‘n baie vinnige manier is om dispute op te los – tipies kan sake binne ‘n paar maande afgehandel word. Die hoof nadeel is koste: die partye betaal nou ook die arbiter, transkripsie kostes en dalk ook ‘n fooi vir lokaalhuur. Ons is beskikbaar om te sit as arbiter in kommersiële dispute, teen ‘n billike tarief. Ben het die AFSA Kommersiële Arbitrasie-kursus in Augustus 2015 suksesvol voltooi, en is daarna aangestel op die paneel van AFSA se kommersiële arbiters. Hy is ook ‘n goedgekeurde arbiter op die panele van die Kaapse Wetsgenootskap en die Prokureursorde van Suid-Afrika, en praktiseer al as prokureur vir meer as 15 jaar. Ons kan dus behulpsaam wees wanneer ‘n ooreenkoms bepaal dat ‘n dispuut verwys moet word na arbitrasie voor ‘n prokureur. Ons kan natuurlik ook partye help waar hul dispute vir arbitrasie verwys is, en ons het al heelwat sulke arbitrasies afgehandel.

Arbitration is an alternative to litigation, where the parties agree to appoint a specific person or have a person nominated by an independent third party such as a law society, to adjudicate the dispute between them. The main benefit of arbitration above litigation is that it is a much more speedy way to resolve disputes. Typically, matters can be finalised within a few months. The main disadvantage is the costs, as the parties now also pay the arbitrator, transcription costs, and perhaps a venue fee. We are able to sit as an arbitrator in commercial disputes, at a reasonable tariff. Ben successfully completed the AFSA Commercial Arbitrations Course in August 2015 and was subsequently appointed to the AFSA Panel of Commercial Arbitrations. He is also an approved arbitrator on the panels of the Cape Law Society and the Law Society of South Africa and has been practising as an attorney for more than 15 years. Where an agreement between parties provides for referral of such dispute to arbitration by an attorney, we would be able to assist. We can, of course, also assist a party when their matter has been referred to arbitration, and have dealt with a number of arbitrations.
